Lead Safe Weatherization Policy Change

Common renovation activities like sanding, cutting, and demolition can create hazardous lead dust and chips by disturbing lead-based paint, which can be harmful to adults and children. To protect against this risk, on March 31, 2008, EPA issued a new rule requiring the use of lead-safe practices and other actions aimed at preventing lead poisoning. Under the rule, beginning in April 2010, contractors performing renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 must be certified and must follow specific work practices to prevent lead contamination. These new regulations will be incorporated into CSD's lead-safe weatherization policies at the appropriate time. However, the notification requirement for occupants of pre-1978 homes has changed and is effective December 22, 2008.

Please note, the State of California has changed the effective year for lead-paint regulations to be applicable to homes built before 1978 (from 1979) and are now in line with the Federal government. However, CSD will not change the applicable year from 1979 to 1978 until Program Year 2009 when we release the new LIHEAP and DOE contracts.

Per EPA regulations:

Homes weatherized before December 22, 2008, owners and occupants of a dwelling built before 1978 must receive the pamphlet "Protect Your Family from Lead in Your Home."

Homes weatherized after December 22, 2008, owners and occupants of a dwelling built before 1978 must receive the pamphlet "Renovate Right: Important Lead Hazard Information for Families, Child Care Providers and Schools."

The Client Education Confirmation of Receipt (CSD 321) form has been updated to reflect the change and will be available on the CSD website for use effective December 22.
